بعده فانه لما كان من المقرر شرعا ان الملك الحقيقي لله تعالى وان الناس مستخلفون فيما ملكهم الله تعالى من الاموال والاملاك وان من حق ولي الامر ان يتصرف في اموال الرعية بما فيه مصلحتهم العامة وان من واجب الرعية ان يطيعوا ولي امرهم فيما يامرهم به من التصرفات المالية التي تعود بالنفع على المسلمين عامة وان من المقرر ايضا ان الاوقاف الاسلامية انما هي من الاموال العامة التي يجب ان تصرف في مصالح المسلمين وان من حق ولي الامر ان يتصرف فيها بما يراه محققا لمصلحة المسلمين وان من المقرر كذلك ان الاراضي الموات والاراضي المفتوحة عنوة انما هي ملك لبيت مال المسلمين وان من حق ولي الامر ان يتصرف فيها بما يراه محققا لمصلحة المسلمين ولما كان من المقرر ايضا ان من حق ولي الامر ان يفرض على الرعية من الضرائب والرسوم ما يراه لازما لسد حاجات الدولة وتحقيق مصالح المسلمين وان من واجب الرعية ان يؤدوا ما يفرض عليهم من ذلك طاعة لولي امرهم ولما كان من المقرر كذلك ان من حق ولي الامر ان يامر بتنفيذ ما يراه من الاحكام الشرعية والقوانين الوضعية التي تحقق مصلحة المسلمين وان من واجب الرعية ان يطيعوا ولي امرهم في ذلك ولما كان من المقرر ايضا ان من حق ولي الامر ان يعين من يراه صالحا للقيام بالمهام الادارية والقضائية وغيرها من المهام التي تحقق مصلحة المسلمين وان من واجب الرعية ان يطيعوا من يعينه ولي الامر في ذلك ولما كان من المقرر كذلك ان من حق ولي الامر ان يعزل من يراه غير صالح للقيام بالمهام الموكلة اليه وان يعين بدلا منه من يراه صالحا لذلك ولما كان من المقرر ايضا ان من حق ولي الامر ان يحاسب من يتولى المهام العامة على ما يقوم به من اعمال وان يعاقبه ان ثبت تقصيره او تعديه ولما كان من المقرر كذلك ان من حق ولي الامر ان

يامر بما يراه محققا لمصلحة المسلمين من الاعمال والتصرفات وان من واجب الرعية ان يطيعوا ولي امرهم في ذلك لذلك فقد امرنا بما يلي اولا ان تكون جميع الاراضي الموات والاراضي المفتوحة عنوة ملكا لبيت مال المسلمين ويتصرف فيها ولي الامر بما يراه محققا لمصلحة المسلمين ثانيا ان تكون جميع الاوقاف الاسلامية تحت اشراف ولي الامر ويتصرف فيها بما يراه محققا لمصلحة المسلمين ثالثا ان يفرض على الرعية من الضرائب والرسوم ما يراه لازما لسد حاجات الدولة وتحقيق مصالح المسلمين رابعا ان ينفذ ما يراه من الاحكام الشرعية والقوانين الوضعية التي تحقق مصلحة المسلمين خامسا ان يعين من يراه صالحا للقيام بالمهام الادارية والقضائية وغيرها من المهام التي تحقق مصلحة المسلمين سادسا ان يعزل من يراه غير صالح للقيام بالمهام الموكلة اليه وان يعين بدلا منه من يراه صالحا لذلك سابعا ان يحاسب من يتولى المهام العامة على ما يقوم به من اعمال وان يعاقبه ان ثبت تقصيره او تعديه

Başbakanlık Ottoman Archive, Istanbul Divan Kalemi, A DVN 65/34 28 Jumādā `l-Ulā 1083 (21 September 1672) 1. باعث تحرير الحروف وموجب تسطيرها هو انه بالديوان العالي بمصر المحروسة بحضرة كخدا مولانا الوزير المعظم المشير المفخم الدستور المكرم مدبر امور جمهور العالم 2. باعلى الهمم مشيد اركان الدولة والاقبال مسدد عنوان الصولة والاجلال مولانا الوزير ابراهيم باشا يسر الله تعالى له من الخيرات ما يشا محافظ مصر المحمية دامت دولته 3. البينة وقدرة الاماجد مستجمع المحامد مولانا على اغا لدى سيدنا افتخار قضاة الاسلام كمال ولاة الانام معتمد السادة الموالي العظام محرر القضايا 4. والاحكام مولانا قاضى الديوان الراقم توقيعه الكريم اعلاه دام علاه ادعى المحترم عبد الله بن مكى من اهالى البنود بولاق قال ما على قدر الاعيان محمد اغا 5. قلعة المويلح بن القاضى احمد الحبيبى بن الدعى المذكور بملك مركب جلبة مجراه بالبحر الملح وانها وسقت من بندر البينبع افضنة وبنا وتقلا واسلابا 6. للدعى المذكور ولجماعة من التجار وسافرت من البينبع المذكور قاصدة الى القصر الشامى ودبها عبد الفتاح اخى الدعى المذكور واولاد اعمامه محمد بن سليمان 7. وعمر بن احمد الى ان وصلت المركب المذكورة للقرب من المويلح وكان جماعة من العربان المفسدين قطاع الطريق تجهزوا فى سبع وعلم قواويس 8. يريدون الهجم على المركب المذكورة فلما احتووا بهم اهالى قلعة المويلح قبضوا على ثلاثة انفار من اعيانهم ووضعو هم فى الحديد وسجنوهم بالقلعة 9. وهم وتر رفيقهم فتعدى محمد اغا المدعى عليه المذكور واطلق الثلاثة انفار المذكورين واعطاهم هم ورفيقهم ذخيرة والكسكساط 10. والجبن والدخان واعانهم بالات السلاح واغراهم على مركب المدعى المذكور وامرهم بالهجم عليها واخذ ما فيها

فنزلوا فى الزعلم قواويس المذكورة 11. وهجموا على مركب المذكور ونهبوا جميع ما فيها من النقد والبن والاقمشة والاسلاب الذى له وللتجار وقتلوا احمد عنه عبد الفتاح واولاد اعمامه المذكورين واولاد 12. عمه محمد وعمر المذكورين فى البحر وعادوا بما نهبوه من المركب واعطوا منه جانبا لمحمد اغا المدعى عليه المذكور وكتبداه حسن وارسل من الاقمشة البينبع تباع 13. بمصر وبطلب ما تبق عنه من المركب عن ذلك اجاب بالانكار فى ذلك وكلف المدعى سبل المدعى عليه المذكور عن ذلك اجاب بالانكار فى ذلك وكلف المدعى المذكر البيان على ذلك فاحضر كل 14. من فخر امثاله احمد بن حسين الجريجى بالقلعة المذكورة ومحمد بن عبد الله جاويش القطعة المرقومة واستشهدهما عما يعلمانه من ذلك فاقام كل منهما شهادته 15. لدى مولانا قاضى الديوان الموصى اليه اعلاه بوجه محمد اغا المدعى عليه المذكور بان جماعة من العرب المفسدين نحو سبعة عشر رجلا معهم سبعة قواويس المذكورة 16. الى القلعة وقالوا نحن نريد نهب المركب المذكورة فقبضوا منهم اهل القلعة المذكورة على ثلاثة انفار ووضعوهم فى الحديد وسجنوهم بالقلعة المذكورة 17. فاطلقهم محمد اغا المدعى عليه المذكور ودفع لهم ذخيرة من الكسكساط والجبن والدخان ونزلوهم ورفيقهم فى الزعايم المذكورة وهجموا على المركب 18. المذكورة وضربوا اهلها ونهبوا ما فيها زاد محمد جاويش المذكور فى شهادته وانهم احضروا لمحمد اغا المدعى عليه المذكور وكتبداه حسن جانبا مما 19. نهبوه من المركب وانهما ارسلا من ذلك كمسين بقة تباع لهما بمصر المحروسة بشهادة شرعية مقبولة شرعا بما يعد تركيب كتبهما بشهادتهما كل من فخر امثاله محمد بن عبد الله بن احمد من طايفة مستحفظان كل منهما التزكية الشرعية وصدق محمد اغا المدعى عليه المذكور على القبض على الثلاثة

23. ثبوتاً شرعياً طلب منه المدعى المذكور اجرا الشرع الشريف في شأن ذلك اجابه لذلك وعرّف مولانا قاضي 24. الديوان الموصى اليه اعلاه محمد اغا المدعى عليه المذكور انه يحرم عليه اطلاق العرب المفسدين واعانتهم بالذخيرة على نهب اموال المسلمين ووجه 25. ما يراه الشرع الشريف في شأن ذلك تعريفاً وتوجيهاً شرعيين وعلى ما جرى وقع التحرير في ثامن عشرين جمادة الاولى 26. من شهور سنة ثلاث وثمانين بعد تمام الالف من الهجرة النبوية على صاحبها افضل الصلاة وازكى التحية وحسبنا الله ونعم الوكيل

Translation

The cause of the writing of the letters, the reason for their composition, is as follows: At the Dīwān al-ʿĀlī in the protected [city of] Cairo, in the presence of the lieutenant of our leader the august governor, the honorable commander, the revered minister, the most zealous manager of the affairs of the people of the world, who builds the pillars of fortune and prosperity, who arranges the emblem of power and glory, our leader the governor Ibrāhīm Pasha, may God Almighty grant him the blessings he desires, the defender of protected Cairo, may his magnificent fortune endure, and the exemplar of the nobles, the collector of virtues, our leader ʿAlī Āghā, and before our leader, pride of the judges of Islam, perfection of the leaders of humankind, the support of the great lords, the issuer of judgments and rulings, our leader the Qāḍī of the Dīwān, whose signature is written above, may his exaltedness endure.

The respected ʿAbdullāh ibn Makkī, of the people of Abnūd in the province of Qinā, sued the pride of the notables Muḥammad, āghā of Muwaylih fortress, son of the qāḍī Aḥmad al-Ḥabībī. The aforementioned plaintiff [claimed that] he owned a boat which he ran on the Baḥr al-Malḥ. [He claimed that] the boat was loaded in the port of Yanbuʿ with cloth, coffee, cash and [other] goods, belonging to the plaintiff and to a group of merchants. It traveled from the aforementioned Yanbuʿ in the direction of al-Qaṣr al-Shāmī, carrying ʿAbd al-Fattāḥ, the brother of the aforementioned plaintiff, and the sons of his paternal uncles Muḥammad ibn Sulaymān and ʿUmar ibn Aḥmad. As the aforementioned boat approached al-Muwaylih, a group of corrupt Arab bandits prepared seven coracles, 1 intending to attack the aforementioned boat. When the soldiers at the fortress noticed [the bandits], they arrested three of their notables, manacled them and imprisoned them in the fortress as a precaution against them and their colleagues doing evil. The aforementioned defendant Muḥammad Āghā intervened and freed the three aforementioned people, gave them supplies, biscuits, cheese and tobacco, and assisted them with weapons, and incited and ordered them to attack the aforementioned plaintiff's boat and take the goods on it. They went out in the aforementioned coracles, attacked the aforementioned boat and plundered all the cash, coffee, cloth and goods that belonged to [the plaintiff] and to the merchants.

They killed [the plaintiff's] brother ʿAbd al-Fattāḥ and threw his aforementioned cousins Muḥammad and ʿUmar into the sea. They returned with the booty from the boat and gave a cut to the aforementioned defendant Muḥāmmad Āghā and his lieutenant Ḥasan, [who] sent some calicoes from the [consignment of] cloth to be sold in Cairo.

[The plaintiff ʿAbdullāh] demanded what the sharīʿa required. The aforementioned defendant was questioned about this, and he denied the claim, and charged the aforementioned plaintiff

with proving it. [ʿAbdullāh] summoned all of: the pride of his peers, Aḥmad ibn Ḥusayn, the Çorbacı of the aforementioned fortress, and Muḥammad ibn ʿAbdullāh, the Çavuş of the aforementioned fortress. He asked them to testify about what they knew of the matter. Both gave testimony before our leader the aforementioned qāḍī of the Dīwān, in the presence of the aforementioned defendant Muḥammad Āghā. [They testified that] a group of corrupt Arabs numbering around fifty men, with seven coracles, came to the fortress saying that they wanted to plunder the aforementioned boat. The people of the fortress arrested three individuals from among them, manacled them and imprisoned them in the aforementioned fortress. The aforementioned defendant Muḥammad Āghā freed them, and gave them supplies of biscuit, cheese and tobacco. They and their colleagues went out in the aforementioned coracles, attacked the aforementioned boat, beat its crew, and plundered its cargo. The aforementioned Muḥammad Çavuş, in his testimony, added that they presented to the aforementioned defendant Muḥammad Āghā and his lieutenant Ḥasan a cut of the booty from the boat, and that the two sent fifty calicoes to be sold on their account in protected Cairo. [This was] legally-valid testimony, accepted in a legal fashion, after the integrity of the witnesses was evaluated by the testimony of both the pride of his peers, Muḥammad ibn ʿĪsā, and Abū Bakr ibn Aḥmad, both of whom members of the Janissary regiment, in a

legally-valid evaluation. The aforementioned defendant Muḥāmmad Āghā admitted that the three men from the aforementioned Arabs had been arrested, manacled and imprisoned in the fortress, and that he freed them afterwards. When the meaning of what was described above was established, in a legally-valid manner, before our leader the aforementioned qāḍī of the Dīwān, with the testimony of his witnesses, in his presence, orally and face to face, the aforementioned plaintiff requested the implementation of the noble sharīʿa on this matter. Our leader the aforementioned qāḍī of the Dīwān responded and notified the aforementioned defendant Muḥammad Āghā that he was guilty of freeing the corrupt Arabs and provisioning them in order to plunder the possessions of the Muslims, and imposed on him what the noble sharīʿa deems necessary for this matter, in a legal notification and imposition. According to what occurred, the record was written on 28 Jumādā al-Ūlā, of the months of the year 83 after the completion of 1000 [years] from the prophetic migration, most excellent prayers and purest salutations upon its participants. God is sufficient for us and He is the best guide.
